Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Ultimate eSign application (the “App”) provided by Inception Software LLP (“we”, “us”, “our”) on the monday.com platform. By installing or using the App, you (“you”, “Customer”) agree to these Terms. If you do not agree, do not install or use the App.
1. The Service
Ultimate eSign connects your monday.com account with Adobe Sign, allowing you to send documents for electronic signature from monday.com items and boards, track signature status, and store signed documents back on your board.
2. Eligibility and accounts
You must have a valid monday.com account and the necessary permissions on your account to install and use the App. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it.
3. Authorization and third-party services
To function, the App requires you to authorize access to your monday.com account and to connect an Adobe Sign account. Your use of Adobe Sign is also subject to Adobe’s own terms and policies. We are not responsible for the availability, performance, or actions of third-party services.
4. Subscriptions, plans, and billing
- The App is offered on a freemium basis: a Free plan with usage limits, and paid plans (Pro, Unlimited) with higher or unlimited limits.
- Paid plans may include a 14-day trial.
- All billing, payments, upgrades, downgrades, and cancellations are handled through monday.com’s subscription system. We do not collect or store your payment details.
- Plan limits (e.g. the number of documents you may send) are enforced according to your active plan.
5. Acceptable use
You agree not to:
- Use the App for any unlawful, fraudulent, or harmful purpose;
- Send documents you are not authorized to send, or use the App to harass or deceive recipients;
- Attempt to bypass plan limits, reverse engineer, disrupt, or gain unauthorized access to the App or its infrastructure;
- Use the App to transmit malware or violate the rights of any third party.
6. Customer data and privacy
Your use of the App is also governed by our Privacy Policy [link to your Privacy Policy], which describes how we collect, use, store, and protect data. You are responsible for ensuring you have the right to process and send any documents and recipient information through the App.
7. Intellectual property
The App, including its software, design, and content, is owned by Inception Software LLP and protected by applicable laws. These Terms do not grant you any ownership rights in the App. You retain all rights to your own documents and data.
8. Service availability and changes
We strive to keep the App available and reliable but do not guarantee uninterrupted or error-free operation. We may modify, update, or discontinue features of the App at any time. We will make reasonable efforts to notify you of material changes.
9. Disclaimer of warranties
The App is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will meet your requirements or that signatures processed via Adobe Sign will be legally valid in your jurisdiction — that depends on Adobe Sign and applicable law.
10. Limitation of liability
To the maximum extent permitted by law, Inception Software LLP shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising out of or related to your use of the App. Our total liability for any claim shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.
11. Communications
By using the App, you agree that we may contact you using the email address or account information associated with your use of the App, including for:
- service-related messages (security, support, technical, or billing notifications); and
- updates about the App, new features, and offers.
You may opt out of non-essential marketing communications at any time by contacting us at support@inceptionsoftware.org or using the unsubscribe option in such messages. Essential service-related messages cannot be opted out of while you use the App.
12. Termination
You may stop using the App and uninstall it at any time. We may suspend or terminate your access if you breach these Terms. Upon uninstallation, your data is handled and deleted as described in our Privacy Policy (all End User Data deleted within 10 days of uninstall).
13. Indemnification
You agree to indemnify and hold harmless Inception Software LLP from any claims, damages, or expenses arising from your misuse of the App or violation of these Terms.
14. Governing law
These Terms are governed by the laws of Uttar Pradesh, without regard to conflict-of-law principles. Any disputes shall be subject to the courts of Noida District Court, Uttar Pradesh, India.
15. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date. Continued use of the App after changes constitutes acceptance.
